Terms of the sales

The contract between Comas di Mascazzini V. & C. s.n.c. and Customer must be considered concluded with the acceptance, even if only partial, of the order by Comas. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read and accepted in all its parts, all the information provided to him during the purchase procedure, the offer of product specifications, and these Conditions of Use and Sale in their entirety.

The Customer declares that he has not entered false or fictional data in the order form, and therefore declares that data entered correspond to his real personal data. Site registration

Product availability

The Customer can only purchase the products in the electronic catalog available on the Site at the time of placing the order, in available quantities reported. The availability of the product can be viewed by entering the description of the same or from the cart. If the quantity of the ordered product exceeds that in stock, it will be displayed that the quantity is not available, giving the customer the possibility to change the quantity. Preorder products

Order acceptance and fulfillment

COMAS reserves the right to accept only orders from subjects in possession of a Tax Code and / or VAT number (or equivalent data if not resident in Italy) and who have reached the age of majority.

Goods collection at the Reefsnow.com Headquarters

For Customers who want to make the online purchase of products with collection and balance at our headquarters (collection in store), collection is only possible during the opening hours of the store available on the contact page. Products: Shipping and delivery

The packaging and shipping costs are charged to the Customer, except for special promotions implemented on the Site. Retention of title

COMAS reserves the ownership of the goods supplied until the Customer has fulfilled all the obligations towards him and in particular until the full payment of the price. This retention of title does not hinder the transfer of risks which will in any case be borne by the Customer from the date on which the products ordered have left the COMAS warehouses in accordance with the provisions of the section "Shipping and delivery of products"

Return of a product

A product can be returned for:

  • Guarantee: all goods sold on the Site enjoy the guarantee provided by the supplying companies with effect from the date of purchase. The warranty period is valid for at least 24 months for the consumer (a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase by requesting an invoice by specifying a VAT number in the order form); 12 months for purchases made by companies. To use it, the Customer must strictly keep the proof of purchase (receipt or invoice) and the transport document received upon delivery of the goods, the original packaging of the product received.
    Repair interventions during the warranty period are guaranteed through the Service Centers authorized by the individual manufacturers. Transport costs related to sending for repair and returning the repaired product are charged to the customer, unless otherwise specified in the specific manufacturer's warranty policies (many manufacturers carry out the return of the product under warranty at their own expense). If, following intervention by an authorized Service Center, the original problem does not turn out to be a defect of non-conformity covered by warranty, the Customer will be charged for any test, verification and restoration costs provided for by the Service Center.
    The replacement of the product in case of "product not working on delivery" will be implemented only if expressly provided for by the specific manufacturer.
    The timing of replacement or repair of the product depends exclusively on the manufacturer's policies. In the event that, for any reason, it is not possible to return a product under warranty (restored or replaced) to the Customer, COMAS will refund the price paid. In all cases, the goods to be repaired or replaced must be returned to COMAS by the Customer, at his expense, in the original packaging, complete in all its parts (original packaging, documentation and accessory equipment), and affixing the label provided by COMAS, which specifies the RMA number (return authorization code).
  • Product does not conform to the one purchased: it is possible to return a product for manufacturing defects and for sending a wrong product, within the mandatory term of 48 hours from delivery.
  • Lack of conformity existing at the time of delivery of the goods (articles 128-135 of Legislative Decree no. 206 of 06/09/2005). The legal guarantee in favor of the consumer covers defects of conformity, existing at the time of delivery well, that they manifested themselves at the delivery of the good itself. The lack of conformity must be communicated, under penalty of forfeiture, within two months from the date on which the Customer discovered the defect. The warranty is not applicable, for example, in the event of negligence, carelessness in the use and maintenance of the product, connection of the product to electrical systems or any other type not compliant with the law.   • Right of withdrawal: pursuant to art. 49 Legislative Decree 206/2005 as amended by Legislative Decree 21/2014, if the Customer is a consumer (a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by requesting an invoice specifying a VAT number in the order form), you can exercise the right of withdrawal, for any reason and without the need to provide explanations. Without prejudice to the cases of exclusion listed below, the right of withdrawal can be exercised within 14 days of receipt of the goods purchased, by written communication sent by registered letter with return receipt, which shows the will to withdraw from the contract. . In case of damage to the goods during transport, COMAS will notify the Customer of the incident within 5 days of receipt of the goods in its warehouses, to allow him to promptly file a complaint against the courier he has chosen and obtain a refund of the value of the goods.     • COMAS is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;

If the package and / or the original packaging are damaged, COMAS will deduct a percentage from the refund due, in any case not exceeding 10% of the same, as a contribution to the costs necessary for the restoration;
    • if COMAS has collected the price of the product from which it withdraws, it will refund the Customer the relative amount (minus any sums to restore the packaging), by bank transfer, within 30 days from the date of notification of the withdrawal by registered mail and not before receiving the product.
    • It will be the Customer's responsibility to promptly provide the bank details (ABI Code - CAB - Current Account of the order holder) on which to obtain the transfer. The cost of the operation will be withheld.
    • If you wish to withdraw from the purchase of one or more products that have actively contributed to the achievement of the threshold for the "Free Shipping" formula, the costs incurred by ReefSnow.com for delivery of the goods not originally charged to the customer.
    • If one or more products for which the withdrawal from the purchase is requested has made it possible to obtain a free or discounted product, the customer is required to return the product or can withhold it by paying the difference, in the case of a discounted product or the full cost. , in the case of a free product

General rules for return a product

The customer will receive a confirmation email with an RMA number (return authorization code) and an email response to the problem illustrated in the "return request". The refund is in accordance with our courier's standard rates. Additional costs cannot be refunded. We offer the possibility of having the package picked up by our courier, directly at the customer's home, upon payment of the shipping costs as per our table.

For any civil and criminal dispute deriving from the conclusion of this distance sales contract, the competent court will be that of the municipality of COMAS residence. In the event of a refund procedure, Reefsnow.com will re-credit the customer the amount due within 30 working days from the date of the request for refund of the money.
